WIPO restores marutisuzuki.com domain name to Maruti, Suzuki

The World Intellectual Property Organisation has ruled that the domain name marutisuzuki.com should be transferred from an Indore-based company to Maruti Udyog Limited of India and Suzuki Motor Corporation of Japan.

The Indore-based World Information Pages has been using marutisuzuki.com Web site offering free services related to lost and found property since February last year. It was registered by the US-based Network Solutions Resolution.

On July 27, Maruti Udyog and Suzuki filed a complaint with the Geneva-based WIPO arbitration and mediation centre. Practising advocate Maninder Singh ruled that the World Information Pages failed to show any justification and has no rights and legitimate interests in respect of domain name marutisuzuki.com.

On the other hand, Maruti is a registered brand under the Indian Trade and Merchandise Marks Act 1958 since October 25, 1976. Also, Suzuki is registered under trademark laws in various countries.

They hybrid trademark 'Maruti Suzuki' has been used on products of the joint venture company in India.

The Indore-based World Information Pages had claimed that the word Maruti is name of an Indian god.
